Typically, lawyers in England and Wales are engaged by lawyers or individuals directly through what is known as “direct access” to represent them in court. The role of a lawyer is to “translate and structure his client`s point of view on events into legal arguments and to make convincing presentations that achieve the best possible outcome for his client”. You know, lawyers and lawyers are both lawyers, but what`s the difference? If you have the idea that lawyers do the paperwork — wills, contracts, et cetera — and lawyers do the work in the courtroom, you are partly right. The vast majority of lawyers are lawyers and, yes, the documents are correct. They may represent clients in lower courts and, in some cases, in higher courts. Nevertheless, in most court cases, a client hires a lawyer, who in turn hires a lawyer to present the case to the court. The holder may use the PC post-nominal letters after his name. A KC is a highly experienced lawyer or lawyer who is recognized as an expert and leader in their field of law. A KC often takes the lead in cases, especially very complex cases, that require more experience and expertise. The Lieutenant Governor of Council (i.e., the Provincial Cabinet) makes appointments on the recommendation of a committee composed of the President of the Law Society of Prince Edward Island, a member of the Law Society Council, a person appointed by the provincial Minister of Justice, a judge of the Court of Appeal or the Supreme Court of Prince Edward Island. and a judge of the Provincial Court of Prince Edward Island. The Committee`s recommendations must be adopted by at least 4 votes to 5. [87] To be appointed, a lawyer must have spent 10 years with the Prince Edward Island Bar Association. The lawyer must also meet the following three criteria: (1) must be instructed in law; (2) must consistently have a high level of professional integrity; and (3) must be of very good character. In addition, the lawyer must meet at least one of the following six criteria: (1) must have a reputation for excellence in legal practice; (2) must be recognized as chief legal counsel; (3) must have a great deal of expertise and reputation; (4) must have demonstrated exceptional leadership in the legal profession; (5) have attained excellence in the field of legal training or jurisprudence; or (6) must have made a major contribution to community affairs or public service. [88] In 2016, the government appointed two lawyers as Queen`s Counsel.
[89] The existence of a position as high as Queen`s Counsel dates back to 1597, when Sir Francis Bacon took precedence over the bar during the reign of Queen Elizabeth I.
